1. Anti-Terrorism day is celebrated on 21 May each year, it is celebrated due to the murder of India's 7th Prime Minister, Rajiv Gandhi by a terrorist of Tamil Nadu. 

2. International Tea day is also cerebrated on 21 May. It is celebrated to upgrade the financial situations of tea vendors and sellers. National Tea Day is celebrated  by FAO. FAO- Food and Agriculture Organization, Established- 1945, Head office- Rome (Capital of Italy).

3. Chinese government has put 80% tariff on Australia's goods which China is selling to Australia, this tariff is due to Australia's offer of  independent research of  Covid-19. Tariff is a type of tax. Australia- Capital- Canberra, Currency- Australian Dollar, Prime Minister- Scott Morrison. Australia is also called the game capital of the world as here 60%-80% people are involved in games.

5. Central government of India has started a program in Konark, a city of Odisha. This program's motto is to make the city 100% solar powered. This program costs 250 Million or 25 crore INR. Sun Temple is situated in Konark.

6. Dilip Ummen is declared the new president of Indian Steel Association. Indian Steel Association- established- 2015, Head office- New Delhi.

7. RBI has banned 14 NBFC license as they did't follow the rules. NBFC means- Non-Banking Finance Corporation. RBI- Reserve Bank of India, established- 1 April 1935, Head-office- Mumbai.

8. Maharashtra government has started a new program for help of farmers. This program's name is 'Mi Annapurna Pahal'. Maharashtra- Capital- Mumbai, Chief Minister- Uddhav Thakre, Governer- Bhagat Singh Koshyari.

12. 'Sukoon Covid-19 Beat the Stress' is a channel which is started by Jammu and Kashmir. It is meant for the help of the who are facing stress and depression in this locked conditions of Covid-19. Jummu and Kashmir, and Ladakh have become two Union territories of India. Ladakh is become the first Union territory of India to become Covid-19 free.

13. World Bank's new economist is Carmen Reinhart.

14. In Ranchi 'Tatpar Karyakram' is a program started for help of the people who are walking to go to their home village or city near Ranchi. This program finds these people and provides vehicles to them to go their village or city, for this government has  declared a helpline number- 1950.

Importance of Date in a pleading

Hello friends, if you are planning to approach Court in a case then you must know all the material facts clearly about the incidence specifically Dates related to that matter. Here I am sharing some abstract from a Supreme Court Judgement in which the actual date of a material fact pleaded by the respondent was not known to them. Title: Mahoora Bano vs National Insurance Company

Case no. CIVIL APPEAL No.78 OF 2020 (arising out of Special Leave Petition (C) No.5580 of 2018)

HON'BLE MR. JUSTICE N.V. RAMANA HON'BLE MR. JUSTICE V. RAMASUBRAMANIAN

Summary of Order passed (only for study purpose)

1. Leave granted.

2. Challenging an Order passed by the High Court allowing an application for review and reducing the compensation originally awarded in an appeal arising out of the award of the Motor Accident Claims Tribunal, the claimant has come up with the above appeal.

3. Dt. 17.11.2007 : road accident occurred causing permanent partial  disablement in left arm of appellant. Claim of Rs.30,00,000/ was filed before Motor Accident Claims Tribunal, Srinagar.

The Tribunal awarded a total compensation of Rs.2,75,000/­ as follows:

a)    mental agony: Rs.90,000/­

b)   expenses for employing an attendant: Rs.30,000/­

c)    medicines and diet: Rs.1,30,000/­

d)   transportation: Rs.25,000/­.

4. Appellant was not satisfied with the amount awarded, so she filed appeal in the High Court of Jammu and Kashmir at Srinagar.

On Dt. 11.06.2014 The High Court enhanced the compensation from Rs.2,75,000/­ to Rs.4,96,600/­ as follows:

a)    loss of income: Rs.2,01,600/­

b)   expenses incurred for taking treatment outside the State: Rs.20,000/­.

5. The award on account of loss of income was on the following grounds:

a)    appellant had an income of Rs.1500/­ per month

b)   60% permanent partial disablement

c)    multiplier of 17 applied upon 60% of the annual income namely Rs.18,000/

d)   Thus amount payable = Rs.2,01,600/­.

6. Insurance company filed a petition for review before the High Court. Insurer appointed a surveyor/investigator to investigate into the claim relating to the employment of the appellant. It was revealed that the appellant, who was employed on a temporary basis as a teacher, got regularized subsequently. Therefore, the Insurance Company sought a review on the short ground that there was no loss of income for the appellant.

7. Appellant was held guilty of suppression of material particulars in her claim petition, as she described her occupation as “household lady engaged in agriculture”. So High Court deleted a sum of Rs.2,00,000/­ which represented the compensation awarded towards loss of income.

8. Appellant was obviously employed as Rehbari Taleem (RT) teacher on a monthly salary of Rs.1500/­.

9. Appellant described her occupation as ­Government teacher, in her suit in Motor Accident Claims Tribunal. Thus it is not wholly correct to say that the appellant was guilty of willful suppression or the commission of fraud upon the Court.

10. Following facts can be seen from the order of Tribunal:

a)    the appellant was working as Rehbari Taleem teacher, earning a monthly income of Rs.1500/

b)   appellant would have completed five years of service and would have been regularized.

c)    On the account of documentary evidence provided by appellant it is clear that she is under Government employment as teacher.

11. All the grounds of appeal before the High Court were focused on inadequacy of compensation towards mental agony, medicines, diet, transportation etc. And she did not focus upon the refusal of the Tribunal to award any compensation for loss of income

12. Following facts can be seen from the order of High Court in the appeal of compensation:

a)    The finding recorded by the Tribunal is, thus, based on assumption, especially so in view of the categorical statement ‘made by the witness, Irshad Ahmad, that the appellant lost the job.’

b)   High Court actually took note of the employment of the appellant as a teacher and the allegation of suppression made against her by the Insurance Company.

13. High Courts observations in review petition: appellant was engaged as ReT and subsequently regularized as a General­line teacher, therefore, the contention raised in the appeal that she was a household lady working in agriculture fields has been proved false.

14. Petition of review by the insurer and the order of the High Court passed in the review application do not contain any date of regularization of the services of the appellant.

Dt. 22.03.2005: appellant was appointed on temporary basis as a teacher and she shall become permanent after 5 years of completion of her service i.e. in March ­2010.

15. On the date on which the appellant deposed before the Tribunal, the statement that she had not been regularized, was not false, but true. The High Court did not even know the date on which the appellant was regularized. Even the review petition filed by the insurer does not disclose the date of regularization. Therefore, the High Court could not have taken a pedantic approach and allowed the review application. Hence, the appeal is allowed and the impugned order of the High Court passed in the review application is set aside. The original order of the High Court passed in the main appeal shall stand restored.

History

Mythological King Putraka created Kupwara for his queen Patali. Anciently it was known as Pataligrama. Also Ajatshatru King of Magadh stayed here for long time. There are evidences that Gautam Buddha spent some time here during his last phase of life.

Well it is founded as District headquarters in 1979.

It is one of the most backward districts of India but still there are many lawful earning activities available. Industries based on the medicinal plants can be beneficial in this area as it is surrounded by forests. Also people can do agricultural work along with dairy farms of cows, buffalos. They can earn huge by domesticating sheep and goats. Woollen & silk based cloths can be manufactured. In small scale industries people can work for embroidery, wooden furniture, leather based products. बाबा बन्दा सिंह बहादुर

भारतवासी आज जो चैन कि श्वास ले रहे हैं और स्वतंत्रता में जी रहे हैं वे हमारे देश के वीर सपूतों, महापुरुषों के बलिदान के कारण ही संभव हुआ है उनमें से एक महापुरुष थे बन्दा बैरागी, जिहोंने अनेक अत्याचार सहकर भी संस्कृति को जीवित रखा पर हम उनके बलिदान दिवस ही भूल गये हैं ।

बाबा बन्दा सिंह बहादुर का जन्म कश्मीर स्थित पुंछ जिले के राजौरी क्षेत्र में विक्रम संवत् 1727, कार्तिक शुक्ल 13 को हुआ था। वह राजपूतों के (मिन्हास) भारद्वाज गोत्र से सम्बन्धित थे और उनका वास्तविक नाम लक्ष्मणदेव था। इनके पिता का नाम रामदेव मिन्हास था।

लक्ष्मणदास युवावस्था में शिकार खेलते समय उन्होंने एक गर्भवती हिरणी पर तीर चला दिया। इससे उसके पेट से एक शिशु निकला और तड़पकर वहीं मर गया। यह देखकर उनका मन खिन्न हो गया। उन्होंने अपना नाम माधोदास रख लिया और घर छोड़कर तीर्थयात्रा पर चल दिये। अनेक साधुओं से योग साधना सीखी और फिर नान्देड़ में कुटिया बनाकर रहने लगे।

इसी दौरान गुरु गोविन्द सिंह जी माधोदास की कुटिया में आये। उनके चारों पुत्र बलिदान हो चुके थे । उन्होंने इस कठिन समय में माधोदास से वैराग्य छोड़कर देश में व्याप्त इस्लामिक आतंक से जूझने को कहा। इस भेंट से माधोदास का जीवन बदल गया। गुरुजी ने उसे बन्दा बहादुर नाम दिया। फिर पाँच तीर, एक निशान साहिब, एक नगाड़ा और एक हुक्मनामा देकर दोनों छोटे पुत्रों को दीवार में चिनवाने वाले सरहिन्द के नवाब से बदला लेने को कहा। बन्दा हजारों सिख सैनिकों को साथ लेकर पंजाब कि ओर चल दिये। उन्होंने सबसे पहले श्री गुरु तेगबहादुर जी का शीश काटने वाले जल्लाद जलालुद्दीन का सिर काटा। फिर सरहिन्द के नवाब वजीरखान का वध किया। जिन हिन्दू राजाओं ने मुगलों का साथ दिया था बन्दा बहादुर ने उन्हें भी नहीं छोड़ा। इससे चारों ओर उनके नाम की धूम मच गयी।

बन्दासिंह को पंजाब पहुँचने में लगभग चार माह लग गये। बन्दा सिंह महाराष्ट्र से राजस्थान होते हुए नारनौल,हिसार और पानीपत पहुंचे,और पत्र भेजकर पंजाब के सभी सिक्खों से सहयोग माँगा। सभी शिक्खो में यह प्रचार हो गया कि गुरु जी ने बन्दा को उनका जत्थेदार यानी सेनानायक बनाकर भेजा है। बंदा के नेतृत्व में वीर राजपूतो ने पंजाब के किसानो विशेषकर जाटों को अस्त्र शस्त्र चलाना सिखाया,उससे पहले जाट खेती बाड़ी किया करते थे और मुस्लिम जमींदार इनका खूब शोषण करते थे देखते ही देखते सेना गठित हो गयी।

इसके बाद बंदा सिंह का मुगल सत्ता और पंजाब हरियाणा के मुस्लिम जमींदारों पर जोरदार हमला शुरू हो गया। सबसे पहले कैथल के पास मुगल कोषागार लूटकर सेना में बाँट दिया गया,उसके बाद समाना, कुंजुपुरा,सढ़ौरा के मुस्लिम जमींदारों को धूल में मिला दिया।

बन्दा ने पहला फरमान यह जारी किये कि जागीरदारी व्यवस्था का खात्मा करके सारी भूमि का मालिक खेतिहर किसानों को बना दिया जाए।

लगातार बंदा सिंह कि विजय यात्रा से मुगल सत्ता कांप उठी और लगने लगा कि भारत से मुस्लिम शासन को बंदा सिंह उखाड़ फेकेंगे। अब मुगलों ने सिखों के बीच ही फूट डालने कि नीति पर काम किया,उसके विरुद्ध अफवाह उड़ाई गई कि बंदा सिंह गुरु बनना चाहता है और वो सिख पंथ कि शिक्षाओं का पालन नहीं करता। खुद गुरु गोविन्द सिंह जी कि दूसरी पत्नी माता सुंदरी जो कि मुगलो के संरक्षण/नजरबन्दी में दिल्ली में ही रह रही थी, से भी बंदा सिंह के विरुद्ध शिकायते कि गई । माता सुंदरी ने बन्दा सिंह से रक्तपात बन्द करने को कहा जिसे बन्दा सिंह ने ठुकरा दिया।

जिसका परिणाम यह हुआ कि ज्यादातर सिख सेना ने उनका साथ छोड़ दिया जिससे उनकी ताकत कमजोर हो गयी तब बंदा सिंह ने मुगलों का सामना करने के लिए छोटी जातियों और ब्राह्मणों को भी सैन्य प्रशिक्षण दिया।

1715 ई. के प्रारम्भ में बादशाह फर्रुखसियर की शाही फौज ने अब्दुल समद खाँ के नेतृत्व में उसे गुरुदासपुर जिले के धारीवाल क्षेत्र के निकट गुरुदास नंगल गाँव में कई मास तक घेरे रखा। पर मुगल सेना अभी भी बन्दा सिंह से डरी हुई थी।

अब माता सुंदरी के प्रभाव में बाबा विनोद सिंह ने बन्दा सिंह का विरोध किया और अपने सैंकड़ो समर्थको के साथ किला छोड़कर चले गए, मुगलो से समझोते और षड्यंत्र के कारण विनोद सिंह और उसके 500 समर्थको को निकल जाने का सुरक्षित रास्ता दिया गया। अब किले में विनोद सिंह के पुत्र बाबा कहन सिंह किसी रणनीति से रुक गए इससे बन्दा सिंह कि सिक्ख सेना कि शक्ति अत्यधिक कम हो गयी।

खाद्य सामग्री के अभाव के कारण उसने 7 दिसम्बर को आत्मसमर्पण कर दिया। कुछ साक्ष्य दावा करते हैं कि गुरु गोविन्द सिंह जी कि माता गूजरी और दो साहबजादो को धोखे से पकड़वाने वाले गंगू कश्मीरी ब्राह्मण रसोइये के पुत्र राज कौल ने बन्दा सिंह को धोखे से किले से बाहर आने को राजी किया।

मुगलों ने गुरदास नंगल के किले में रहने वाले 40 हजार से अधिक बेगुनाह मर्द, औरतों और बच्चों की निर्मम हत्या कर दी।

मुगल सम्राट के आदेश पर पंजाब के गर्वनर अब्दुल समन्द खां ने अपने पुत्र जाकरिया खां और 21 हजार सशस्त्र सैनिकों कि निगरानी में बाबा बन्दा बहादुर को दिल्ली भेजा। बन्दा को एक पिंजरे में बंद किया गया था और उनके गले और हाथ-पांव कि जंजीरों को इस पिंजरे के चारो ओर नंगी तलवारें लिए मुगल सेनापतियों ने थाम रखा था। इस जुलुस में 101 बैलगाड़ियों पर सात हजार सिखों के कटे हुए सिर रखे हुए थे जबकि 11 सौ सिख बन्दा के सैनिक कैदियों के रुप में इस जुलूस में शामिल थे।

युद्ध में वीरगति पाए सिखों के सिर काटकर उन्हें भाले कि नोक पर टाँगकर दिल्ली लाया गया। रास्ते भर गर्म चिमटों से बन्दा बैरागी का माँस नोचा जाता रहा।

मुगल इतिहासकार मिर्जा मोहम्मद हर्सी ने अपनी पुस्तक इबरतनामा में लिखा है कि हर शुक्रवार को नमाज के बाद 101 कैदियों को जत्थों के रुप में दिल्ली कि कोतवाली के बाहर कत्लगाह के मैदान में लाया जाता था। काजी उन्हें इस्लाम कबूल करने या हत्या का फतवा सुनाते। इसके बाद उन्हें जल्लाद तलवारों से निर्ममतापूर्वक कत्ल कर देते। यह सिलसिला डेढ़ महीने तक चलता रहा। अपने सहयोगियों कि हत्याओं को देखने के लिए बन्दा को एक पिंजरे में बंद करके कत्लगाह तक लाया जाता ताकि वह अपनी आंखों से इस दर्दनाक दृश्य को देख सकें।

बादशाह के आदेश पर तीन महीने तक बंदा और उसके 27 सेनापतियों को लालकिला में कैद रखा गया। इस्लाम कबूल करवाने के लिए कई हथकंडे का इस्तेमाल किया गया। जब सभी प्रयास विफल रहे तो जून माह में बन्दा कि आंखों के सामने उसके एक-एक सेनापति कि हत्या की जाने लगी। जब यह प्रयास भी विफल रहा तो बन्दा बहादुर को पिंजरे में बंद करके महरौली ले जाया गया। काजी ने इस्लाम कबूल करने का फतवा जारी किया जिसे बन्दा ने ठुकरा दिया।

बन्दा के मनोबल को तोड़ने के लिए उनके चार वर्षीय अबोध पुत्र अजय सिंह को उसके पास लाया गया और काजी ने बन्दा को निर्देश दिया कि वह अपने पुत्र को अपने हाथों से हत्या करे। जब बन्दा इसके लिए तैयार नहीं हुआ तो जल्लादों ने इस अबोध बालक का एक-एक अंग निर्ममतापूर्वक बन्दा कि आंखों के सामने काट डाला। इस मासूम के धड़कते हुए दिल को सीना चीरकर बाहर निकाला गया और बन्दा के मुंह में जबरन ठूंस दिया गया। वीर बन्दा तब भी निर्विकार और शांत बने रहे।

अगले दिन जल्लाद ने उनकी दोनों आंखों को तलवार से बाहर निकाल दिया। जब बन्दा टस से मस न हुआ तो उनका एक-एक अंग हर रोज काटा जाने लगा। अंत में उनका सिर काट कर उनकी हत्या कर दी गई। बन्दा न तो गिड़गिड़ाये और न उन्होंने चीख पुकार मचाई। मुगलों कि हर प्रताड़ना और जुल्म का उसने शांति से सामना किया और धर्म कि रक्षा के लिए बलिदान हो गया।

देश और धर्म के लिए अपना सर्वस्व न्यौछावर करने और इतनी यातनाएं सहन करने के बाद प्राणों की आहुति दे दी लेकिन न धर्म बदला और ना ही अन्याय के सामने कभी झुके। इन वीर महापुरुषों को आज हिंदुस्तानी भूल रहे हैं और देश को तोड़ने में सहायक हीरो-हीरोइन, क्रिकेटरों का जन्म दिन याद होता है, लेकिन आज हम जिनकी वजह से स्वतंत्र है उनका बलिदान दिवस याद नही कितने दुर्भाग्य की बात है ।

इतिहास से हिन्दू आज सबक नहीं लेगा, संघटित होकर कार्य नहीं करेगा और हिंदू राष्ट्र की स्थापना नहीं होगी तो फिर से विदेशी ताकतें हावी होंगी और हमें प्रताड़ित करेंगी ।
